Terms of Service

These Terms of Service (“Terms”) govern your use of the MyPlacard platform — the booking, dispatch, and payment software that powers a black car or chauffeur Operator's own branded rider app, driver app, and dispatch console. By using any app or console built on MyPlacard, you agree to these Terms.
What MyPlacard Is — and Isn't
MyPlacard is a technology platform, not a transportation company. Rides are provided by independent Operators and their drivers, who are not employees, agents, or contractors of MyPlacard. MyPlacard licenses dispatch software to Operators; each Operator is solely responsible for the actual transportation service — vehicle safety and maintenance, driver licensing and insurance, and conduct during a ride. When you book a ride through an app built on MyPlacard, your contract for that ride is with the Operator, not with MyPlacard.
Accounts
- You must provide accurate information when creating an account or booking a ride
- You're responsible for activity on your account and for keeping your login credentials secure
- You must be at least 18 years old to create a Rider or Driver account
- Guest booking is available without creating an account; providing your phone number for a guest booking is subject to these Terms and our Privacy Policy the same as a full account
Booking, Fares, and Payment
- A fare estimate is shown before you book, based on ride type, distance, and the Operator's own rate card; the final charge reflects the trip actually completed
- Promo codes and referral discounts, where offered, are subject to the terms of that specific code
- Payment is processed by Stripe, our payment processor. By adding a payment method, you authorize the Operator, through MyPlacard, to charge that payment method for your fare and any tip you add
- Tips are optional and, once charged, go entirely to the driver who provided the ride
- Refunds and disputes are handled by the Operator through the console MyPlacard provides them; contact the Operator directly for a refund request
Cancellations
You may cancel a ride before it is completed. An Operator may apply a cancellation charge for a late cancellation or a no-show, consistent with that Operator's own policies. Any authorized-but-uncharged amount is released if a ride is canceled before completion.
SMS Communications
By providing a phone number, you consent to receive transactional text messages about your own ride activity (booking confirmation, driver assigned, driver arriving, trip complete). We do not send marketing messages by SMS. Message and data rates may apply. Reply STOP to a message at any time to opt out, START to opt back in, or HELP for assistance. Conduct
You agree not to:
- Use the platform for any unlawful purpose
- Provide false information when booking a ride or creating an account
- Harass, threaten, or endanger a driver, rider, or Operator staff member
- Attempt to interfere with or gain unauthorized access to the platform
We or the Operator may suspend or terminate access to the platform for a violation of these Terms.
Drivers
If you drive using a MyPlacard-powered driver app, you do so as a driver for the Operator who assigned you, not for MyPlacard. Your eligibility to drive, licensing, insurance, and vehicle standards are set and verified by the Operator, not MyPlacard. Continuous location tracking while your app is online is a required part of how dispatch and safety monitoring work on this platform.
Intellectual Property
MyPlacard's software, design, and branding are owned by MyPlacard. Each Operator retains ownership of their own brand, logo, and business name as applied to their app instance. Nothing in these Terms transfers ownership of either party's intellectual property to the other.
Disclaimers
The MyPlacard platform is provided “as is” and “as available.” We don't guarantee the platform will be uninterrupted, error-free, or available at all times. MyPlacard does not control, and disclaims responsibility for, the actual conduct of an Operator or its drivers during a ride — that responsibility rests with the Operator.
Limitation of Liability
To the fullest extent permitted by law, MyPlacard is not liable for any indirect, incidental, or consequential damages arising from your use of the platform, or from any ride, dispute, or interaction with an Operator, driver, or rider. Our total liability for any claim relating to the platform is limited to the amount you paid to use it in the preceding six months, if any.
Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles, unless a different governing law is required by the law of your state or country of residence.
Changes to These Terms
We may update these Terms from time to time. We'll update the “Last updated” date above, and continued use of the platform after a change means you accept the updated Terms.
